In response to the government's appeal from the District Court's Order declaring that provisions of BAPCPA were unconstitutional, the following appellate brief has been submitted on behalf of Plaintiffs-Appellees:

The BAPCPA order obtained by Milavetz, Gallop & Milavetz, P.A. is currently moving through the District Court system to come to a final appealable order, so the parties can argue before the 8th Circuit Court of Appeals. Both parties hope to expedite this process as soon as possible. Articles on this matter have been written recently in the Pioneer Press and Minnesota Lawyer.
